Off-Road Private Land β€” The Short Answer

Riding an electric dirt bike on private land with the landowner's permission is legal in virtually all US states with no license, registration, or insurance required. This is how the majority of electric dirt bikes are ridden in the US.

Public OHV Land

Most states require OHV (Off-Highway Vehicle) registration or certification to ride on public OHV land (national forests, state parks, designated trails). Requirements vary by state. Always check with your state's OHV agency before riding.

California β€” Major Change: Section 436.1 (November 2025)

California's Section 436.1, effective November 2025, classifies any two-wheeled vehicle with handlebars, a straddled seat, and an electric motor designed primarily for off-highway use as an off-highway motorcycle. This means:

  • Green sticker OHV registration is now required for electric dirt bikes on public OHV land in California
  • Public roads are off-limits without full motorcycle registration, insurance, and appropriate license
  • This applies to Sur-Ron, Talaria, Segway X260, and similar models

Street Legal Requirements (Any State)

For street use on public roads, an electric dirt bike generally must: meet NHTSA motor vehicle safety standards; be registered with your state DMV; have valid insurance; have appropriate lighting (headlight, taillight, turn signals); and the rider must hold a valid motorcycle license. Very few off-road electric dirt bikes qualify without significant modifications. The Stark Varg EX and Zero FX are among the limited models that can be configured for street use.

Age Requirements

Most US states require riders to be at least 16 to operate bikes exceeding 20 mph on public OHV land. Children riding on private land typically have no minimum age, though parental supervision is strongly recommended and required in practice.
